U.S. District Judge April Perry issued a ruling declaring that the Trump Administration’s deployment of federalized Texas National Guard units to Chicago ran afoul of the 10th and 14th Amendments, as well as the Posse Comitatus Act a law that sharply restricts the use of military forces in domestic law enforcement.
Judge Perry’s decision grants a temporary restraining order preventing any further mobilization or deployment of Texas Guardsmen to assist with federal operations in Illinois.
The order came after several Illinois officials and civil rights groups sued the federal government, arguing that the deployment undermined state sovereignty and endangered civilians.
“The federal government exceeded its authority by commandeering state military resources for domestic purposes without proper constitutional or statutory justification,” Judge Perry wrote in her 42-page opinion.
The Trump Administration had defended the deployments as necessary to support federal law enforcement in curbing violent crime and restoring order in parts of Chicago.
Texas officials, meanwhile, maintained that their Guard members were acting at the direction of the federal government under lawful orders.
The restraining order remains in place pending a full hearing on the merits of the case.
Legal experts say the ruling could set an important precedent on the limits of federal power in using state military forces for domestic missions.
